LUV Music Intelligence Platform Terms of Service

1. About These Terms
These Terms of Service ("Terms") govern your access to and use of the LUV Music Intelligence Platform ("LUV", the "Platform", "we", "us" or "our"). LUV Music Intelligence Platform is an independently operated music discovery and analytics platform based in the United Kingdom. If you do not agree to these Terms, you should not use the Platform.
2. YouTube API Services
The Platform uses YouTube API Services and may display, process or analyse information made available through those services. By using functionality incorporating YouTube API Services, you also agree to be bound by the YouTube Terms of Service. YouTube and Google are independent third parties. LUV is not YouTube, Google or an official YouTube analytics product. Nothing on the Platform should be interpreted as indicating endorsement, sponsorship or approval by YouTube or Google.
3. LUV Intelligence and Independent Metrics
LUV may provide independent analytical outputs relating to music, artists, tracks, channels and performance trends. These may include, where available and permitted: music discovery indicators; growth analysis; performance comparisons; rankings and leaderboards; trend analysis; engagement analysis; momentum indicators; lassifications; and other LUV-developed analytical outputs. Any score, ranking, classification, indicator or metric expressly identified as a "LUV" metric is an independently developed LUV analytical output and is not an official YouTube or Google metric. LUV analytical outputs may use permitted third-party information as inputs but may also incorporate independent methodologies, rules, classifications and analysis developed by LUV. The availability and scope of analytical features may depend upon permissions, policies and technical requirements imposed by third-party data providers.
4. No Guarantee of Performance
Music and audience behaviour can change rapidly. Information presented through the Platform is provided for informational and analytical purposes and does not guarantee: future artist performance; commercial success; streaming performance; audience growth; chart performance; investment or financial return; contractual opportunities; or any particular business outcome. Users remain responsible for their own professional, commercial and business decisions.
5. Data Accuracy and Availability
LUV seeks to provide useful and reasonably accurate information but relies partly on information supplied by third-party services. Third-party information may be delayed, unavailable, incomplete, changed or removed without notice. LUV does not warrant that all information will always be complete, current or error-free. We may correct, update, remove or recalculate information where necessary.
6. Accounts
Some Platform functionality may require an account. You are responsible for: providing accurate account information; maintaining the security of your account; keeping authentication credentials confidential; and notifying us if you believe your account has been compromised. You must not attempt to access another person's account without authorisation.
7. Acceptable Use
You must not use the Platform to: violate applicable law; infringe another person's intellectual-property or privacy rights; gain unauthorised access to systems or data; interfere with the security or operation of the Platform; introduce malware or malicious code; scrape or systematically extract Platform data without permission; reverse engineer protected Platform functionality except where applicable law expressly permits it; circumvent access restrictions; impersonate another person or organisation; use LUV data or intelligence deceptively; or represent LUV-derived metrics as official YouTube or Google metrics. You must not use the Platform in a manner that violates applicable YouTube terms or policies.
8. Intellectual Property
Except for third-party content and data, the Platform and its original materials, including its branding, software, interface, methodologies, written analysis, classifications, reports and other proprietary materials, are owned by or licensed to the operator of LUV and are protected by applicable intellectual-property laws. Third-party content remains the property of its respective owner. YouTube audiovisual content, YouTube API Data, YouTube branding and related rights remain subject to the applicable rights and terms of YouTube and relevant content owners. Nothing in these Terms transfers ownership of third-party content or YouTube API Services to LUV or its users.
9. Permitted Use of LUV Information
Unless otherwise stated, access to the Platform gives you a limited, non-exclusive, non-transferable right to use its functionality for lawful personal or internal professional purposes. You may not reproduce, commercially redistribute, resell, sublicense or create a competing database from substantial portions of LUV's proprietary reports, methodologies or analytical outputs without prior written permission. Additional commercial licences or reporting terms may apply to professional or enterprise services if these are introduced.
10. Third-Party Content and Links
The Platform may contain embedded YouTube videos and links to YouTube or other third-party services. Those services are governed by their respective terms and privacy policies. LUV is not responsible for the availability, security or independent practices of third-party websites or services.
11. Availability and Changes
We may update, modify, suspend or discontinue parts of the Platform where reasonably necessary, including in response to: technical requirements; changes to third-party APIs; legal or regulatory requirements; security concerns; changes to YouTube API Services policies; or development of the Platform. We do not guarantee uninterrupted availability.
12. Suspension and Termination
We may restrict or terminate access where reasonably necessary, including where we believe a user has: materially breached these Terms; used the Platform unlawfully; threatened the security of the Platform; abused Platform functionality; or created legal or regulatory risk. Where appropriate and reasonably practicable, we may provide notice.
13. Privacy
Our collection and use of personal information is described in the LUV Music Intelligence Platform Privacy Policy. You should read the Privacy Policy before using the Platform.
14. Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability that cannot lawfully be excluded under applicable consumer law. Subject to those rights and restrictions, and to the extent permitted by law, LUV is not responsible for losses resulting solely from reliance on third-party information, temporary service interruptions, third-party API availability, or business decisions made solely on the basis of analytical information presented through the Platform. Nothing on the Platform constitutes financial, investment or legal advice.
15. Changes to These Terms
We may update these Terms to reflect changes to the Platform, applicable law, our services or third-party requirements. The current version will be published on this page together with its effective or last-updated date. Where required by applicable law, material changes will be communicated appropriately.
16. Governing Law
These Terms are governed by the laws of England and Wales, subject to any mandatory rights that applicable consumer law gives you. The courts of England and Wales will have jurisdiction, except where applicable law gives you the right to bring proceedings elsewhere.
